These terms govern your use of the Hey Creators platform (the Platform). Hey Creators is a trading brand of Exposure Agency Pty Ltd (ACN registered in Australia), the legal entity that operates the Platform, signs commercial agreements with brands, and pays creators (we, us, our). By creating an account, applying to a brief, or accepting a job, you agree to be bound by these terms. If you don't agree, don't use the Platform.

1. What Hey Creators is

Hey Creators is a marketplace that connects brands with creators who produce short-form vertical UGC (user-generated content) shot on phone. We facilitate matching, communication, and payment. We are not a talent agency, we don't employ creators, and we don't guarantee any specific outcome from any job.

2. Eligibility

  • You must be at least 18 years old.
  • You must be legally entitled to work and earn income in your country of residence.
  • We can pay creators in any country supported by Stripe Connect Express (currently 40+ including Australia, New Zealand, the United States, the United Kingdom, Canada, Singapore, Japan, the EU, and others — see Stripe's coverage list for the full set).
  • Australian creators: you must hold a valid Australian Business Number (ABN), or be willing to obtain one before your first paid job. ABN registration is free at abr.gov.au.
  • Creators outside Australia: you are responsible for reporting your Hey Creators income in your country of residence. We do not collect tax forms or file tax returns on your behalf in any jurisdiction outside Australia.
  • You must provide accurate information when you sign up and keep it up to date. Impersonating someone else, or creating multiple accounts to game the system, is grounds for termination.

3. The job flow

  1. Brands publish briefs. Creators apply to briefs they want, or are directly invited by Hey Creators.
  2. When you're assigned a job, you'll see the brief, the rate, the due date, and the deliverable spec.
  3. You film, upload your raw footage by the due date, and respond to up to two rounds of revisions if requested.
  4. When the brand approves your final delivery, payment is released.

4. Payment

The rate per job is set when you accept (or are assigned) the job. Payments are processed by Exposure Agency Pty Ltd (the operator of the Platform) via Stripe Connect Express, and are paid to your connected bank account after brand approval. You will see “Exposure” on your bank statement as the source of the deposit. You are responsible for declaring this income and meeting your tax obligations. We will not withhold tax on your behalf. If you are GST-registered, your payment will be GST-inclusive in line with the ATO's recipient-created tax invoice rules.

If a brand cancels a job after you've been assigned but before you've delivered, we'll work with you in good faith to either reassign or compensate you for time spent — there's no rigid formula, we treat each cancellation case-by-case.

5. Intellectual property

On approval and payment, you grant the brand a perpetual, worldwide, royalty-free licence to use the approved deliverable on digital channels (their website, social media, email marketing, paid digital advertising). You retain the right to share the work in your own portfolio and on your social channels unless we explicitly tell you otherwise for a specific job.

If your delivery includes third-party material (music, fonts, stock footage), you're responsible for clearing those rights. Don't upload anything you don't have the right to use.

6. Off-platform conduct

All communication and payment for jobs sourced through Hey Creators must happen on the Platform. Don't take a brand off-platform to avoid fees, and don't accept off-platform payment for work introduced through us. Doing so is grounds for immediate termination.

7. Conduct

Be professional. Communicate when you're running late. Don't ghost a brand mid-shoot. Don't deliver content you didn't actually film. Don't harass other creators or brands. We investigate complaints in good faith and may suspend accounts at our discretion.

8. Liability

We provide the Platform on an as-is basis. To the maximum extent permitted by law, we're not liable for any indirect or consequential loss arising from your use of the Platform. Nothing in these terms excludes any rights you have under the Australian Consumer Law that can't lawfully be excluded.

9. Privacy

We handle personal information in line with the Privacy Policy, which forms part of these terms.

10. Suspension and termination

We may suspend or close your account if you breach these terms. You can close your own account at any time by emailing gabe@heycreators.com. Closing your account doesn't cancel any in-flight jobs you've already accepted.

11. Changes to these terms

We'll let you know in-app or by email if we make material changes, and we'll ask you to re-accept before you can take on new jobs. Continuing to use the Platform after a change means you accept the updated terms.

12. Governing law

These terms are governed by the laws of New South Wales, Australia. Any dispute will be heard by the courts of NSW.
